Terms and Conditions

I HEREBY ASSUME ALL OF THE RISKS OF PARTICIPATING IN THIS ACTIVITY OR EVENT, including by way of example and not limitation, any risks that may arise from negligence or carelessness on the part of the persons or entities being released, from dangerous or defective equipment or property owned, maintained, or controlled by them, or because of their possible liability without fault. I certify that I am physically fit, have sufficiently prepared or trained for participation in the activity or event, and have not been advised to not participate by a qualified medical professional. I certify that there are no health-related reasons or problems which preclude my participation in this activity or event. I certify that I am in good health and that I do not pose a health risk to the public. I acknowledge that this Accident Waiver and Release of Liability Form will be used by the event holders, sponsors, and organizers of the activity or event in which I may participate, and that it will govern my actions and responsibilities at said activity or event. In consideration of my application and permitting me to participate in this event, I hereby take action for myself, my executors, administrators, heirs, next of kin, successors, and assigns as follows: I HEREBY WAIVE, RELEASE, AND DISCHARGE M.A.D Dance and all divisions thereof of any and all liability and responsibility for injuries, sickness, pandemics, accidents, natural disasters and/or acts of God incurred during participation in and/or instruction of camps, private lessons, or any activity I may participate. I WAIVE, RELEASE, AND DISCHARGE from any and all liability, including but not limited to, liability arising from the negligence or fault of the entities or persons released, for my death, disability, personal injury, property damage, property theft, or actions of any kind which may hereafter occur to me including my traveling to and from this event, THE FOLLOWING ENTITIES OR PERSONS: M.A.D Dance and their employees, volunteers, or the activity or event holders, activity or event sponsors, activity or event volunteers. I INDEMNIFY, HOLD HARMLESS, AND PROMISE NOT TO SUE the entities or persons mentioned in this waiver, release and registration form from any and all liabilities or claims made as a result of participation in this activity or event, whether caused by the negligence of release or otherwise. The accident waiver and release of liability shall be construed broadly to provide a release and waiver to the maximum extent permissible under applicable law. I CERTIFY THAT I HAVE READ THIS DOCUMENT, AND I FULLY UNDERSTAND ITS CONTENT. I AM AWARE THAT THIS IS A RELEASE OF LIABILITY AND A CONTRACT AND I SIGN IT OF MY OWN FREE WILL.

PARENT / GUARDIAN WAIVER FOR MINORS (Only if student is under 18 years old) The undersigned parent and natural guardian does hereby represent that he/she is, in fact, acting in such capacity, has consented to his/her child or ward’s participation in the activity or event, and has agreed individually and on behalf of the child or ward, to the terms of the accident waiver and release of liability set forth above. The undersigned parent or guardian further agrees to save and hold harmless and indemnify each and all of the parties referred to above from all liability, loss, cost, claim, or damage whatsoever which may be imposed upon said parties because of any defect in or lack of such capacity to so act and release said parties on behalf of the minor, the parents, of the legal guardian.

 

我特此承担参加此活动或事件的所有风险，包括但不限于因被释放的个人或实体的疏忽或大意，因其拥有、维护或控制的危险或有缺陷的设备或财产，或因其没有过错而可能产生的任何风险。我证明我身体健康，已经为参加该活动或事件做了充分的准备或训练，并且没有被合格的医疗专家建议不要参加。我证明没有任何与健康有关的原因或问题妨碍我参加这项活动或赛事。我证明我的健康状况良好，不会对公众构成健康风险。我承认本事故弃权和责任免除表将被我可能参加的活动或事件的持有人、赞助商和组织者使用，它将管理我在上述活动或事件中的行为和责任。考虑到我的申请并允许我参加这项活动，我特此为我自己、我的遗嘱执行人、管理人、继承人、近亲、继任者和受让人采取以下行动： 我在此放弃、免除和解除M.A.D.舞蹈团及其所有部门对我在参加和/或指导营地、私人课程或任何活动期间发生的伤害、疾病、大流行病、事故、自然灾害和/或天灾的任何和所有责任和义务。我放弃、免除和解除以下机构或人员对我的死亡、残疾、人身伤害、财产损失、财产盗窃或此后可能发生在我身上的任何形式的行为，包括我往返于本次活动的旅行，包括M.A.D Dance及其雇员、志愿者、或活动或事件的持有人、活动或事件的赞助商、活动或事件的志愿者，所承担的任何和所有责任，包括但不限于因这些机构或人员的疏忽或过失所导致的责任。我对本弃权书、免责声明和登记表中提到的实体或人员进行赔偿，使其免受损害，并保证不起诉他们，因为他们参与本活动或事件而产生的任何和所有责任或索赔，无论是否由免责声明的疏忽或其他原因造成。事故弃权和责任免除应被广泛解释为在适用法律允许的最大范围内提供免除和放弃。我证明我已阅读本文件，并完全理解其内容。我意识到这是一份责任免除书和合同，我是自愿签署的。

父母/监护人对未成年人的免责声明（仅适用于18岁以下的学生） 下面签名的父母和自然监护人在此声明，他/她实际上是以这种身份行事，同意他/她的孩子或被监护人参加活动或事件，并单独和代表孩子或被监护人同意上述事故豁免和责任免除的条款。下面签名的家长或监护人还同意使上述各方免受所有责任、损失、费用、索赔或损害，这些责任、损失、费用、索赔或损害可能由于上述行为能力的任何缺陷或缺乏而强加给上述各方，并代表未成年人、家长和法定监护人免除上述各方的责任。

For Classes: Classes can be cancelled at 6 hours or earlier from client-end. Classes that are not cancelled will be deducted from the purchased session even if you do not attend.

For Private Lessons: Appointments need to be cancelled 24 hours in advance.  Not cancelled appointments will be deducted from the purchased session even if you do not attend.

For group courses: Customer self cancellation is not allowed. Breaks need to be agreed upon by all and communicated to the staff 24 hours in advance.

All M.A.D products and services once sold are not subject to change, exchange, refund or extension of use. M.A.D will not refund the amount spent or the number of times used due to actual experience not matching your expectations, inability to attend the scheduled class for personal reasons, or the number of times charged to your account due to a missed class or failure to cancel a scheduled class in advance. You agree to pay the subscription fee and any other applicable fees stated on the order form or set forth in this Agreement. You are responsible for all subscription fees for the entire subscription period. All payment obligations under this Agreement are non-cancelable and all fees paid are non-refundable.

 

M.A.D所有产品和服务一经售出，不予更改、退换、退款、延长使用期。对于因实际体验与您的预期不符、因个人原因无法出席所约课程、因误约课程或未提前取消预约课程致使账户内被扣次等情况，M.A.D不会因此退还消费金额和使用次数。您同意支付订购费和订单表上注明的或本协议中规定的任何其他适用费用。您对整个订购期的所有订购费负责。本协议项下的所有付款义务是不可取消的，所有已支付的费用是不可退还的。
